Please read these Terms of Service ("Terms", "Agreement") carefully before using the SnapAPI service ("Service") operated by SnapAPI ("we", "us", or "our") at getsnapapi.dev. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

1. Definitions

• "Service" means the SnapAPI screenshot and OG image generation API available at getsnapapi.dev.
• "User", "you", "your" means the individual or legal entity that has accepted these Terms and uses the Service.
• "API Key" means the unique credential issued to you upon registration that authenticates your API requests.
• "Content" means any data, screenshots, images, or other material processed through the Service.
• "Subscription" means a paid plan (Pro or Business) that grants higher monthly usage quotas.

2. Acceptance of Terms

By registering for or using the Service, you confirm that you are at least 18 years of age, have the legal capacity to enter into this Agreement, and agree to comply with these Terms. If you are using the Service on behalf of an organisation, you represent and warrant that you have authority to bind that organisation to these Terms.

3. API Key and Account

Upon registration you will receive a unique API Key. You are solely responsible for:

• Maintaining the confidentiality of your API Key.
• All activity that occurs under your API Key.
• Notifying us immediately at support@getsnapapi.dev if you suspect unauthorised use.

We reserve the right to revoke or regenerate your API Key at any time if we reasonably believe it has been compromised or used in violation of these Terms.

4. Permitted Use

The Service is licensed, not sold. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service solely for your internal business purposes. You may use the Service to:

• Capture screenshots of publicly accessible web pages for legitimate business or personal purposes.
• Generate Open Graph preview images for content you own or have the right to use.
• Integrate the Service into your applications, products, or workflows.

5. Prohibited Use

You agree not to use the Service to:

• Scrape, crawl, or systematically harvest data from websites in violation of their terms of service or applicable law.
• Capture, distribute, or store screenshots of content you do not have the right to reproduce.
• Conduct any automated attack, stress-test, or denial-of-service activity against any website.
• Capture content that is illegal, defamatory, obscene, or infringes on intellectual property rights.
• Attempt to circumvent rate limits, quotas, or authentication mechanisms.
• Resell, sublicense, or redistribute the Service or API access to third parties without our written consent.
• Use the Service for any purpose that violates applicable local, national, or international law or regulation.
• Access or attempt to access internal, private, or localhost URLs (such attempts are blocked and logged).

6. Usage Quotas and Fair Use

Each plan includes a fixed monthly request quota that resets on the 1st day of each calendar month. Unused quota does not carry over. We reserve the right to throttle or suspend access if your usage patterns suggest abuse, even within quota limits.

We may update plan limits and pricing with 30 days' notice. Your continued use after that date constitutes acceptance of the updated terms.

7. Payment and Subscriptions

Paid subscriptions (Pro and Business) are billed monthly. Pricing is displayed at getsnapapi.dev/#pricing. By subscribing to a paid plan, you authorise us (via our payment processor) to charge your payment method on a recurring monthly basis.

• Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused periods.
• Refunds: We offer refunds within 7 days of the initial charge for new subscriptions if you have made fewer than 50 API calls. To request a refund, email support@getsnapapi.dev.
• Failed Payments: If a payment fails, your account will revert to the Free plan until payment is resolved.
• Taxes: You are responsible for any applicable taxes, duties, or levies arising from your use of the Service.

8. Intellectual Property

The Service, including its software, APIs, branding, and documentation, is owned by SnapAPI and protected by intellectual property laws. Nothing in these Terms transfers any IP rights to you.

You retain all rights to the screenshots and images generated from your own content. We claim no ownership over output images generated by your API calls.

9. Privacy and Data

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described therein.

We log API request metadata (endpoint, timestamp, IP address, status) for security, billing, and analytics purposes. We do not persistently store the rendered images or the content of the websites you capture.

10. Service Availability and SLA

We aim to provide a reliable service but do not guarantee uninterrupted access. The Service is provided "as is" without warranty of availability. Business plan subscribers receive a 99.9% monthly uptime SLA, credited as account credits for qualifying outages exceeding the SLA threshold.

We reserve the right to perform scheduled maintenance with reasonable prior notice.

11. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SNAPAPI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY UNAUTHORISED ACCESS TO OR USE OF OUR SERVERS; (C) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $50 USD.

12. Indemnification

You agree to indemnify, defend, and hold harmless SnapAPI and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Termination

We may suspend or terminate your access to the Service immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may stop using the Service and delete your account at any time by contacting us. Termination does not entitle you to a refund except as expressly stated in Section 7.

14. Modifications to the Service and Terms

We reserve the right to modify or discontinue the Service at any time. We will provide at least 30 days' notice of material changes to these Terms by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law. Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration. Nothing herein prevents either party from seeking injunctive relief in a court of competent jurisdiction.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and SnapAPI concerning the Service and supersede all prior agreements and understandings.
